Device Description File Agreement

Fisher Controls International LLC (FCII) has developed Device Description files for use with DeltaV, HART, and FOUNDATION fieldbus host software. The Device Description files enable information communication between the FIELDVUE Instrument and a host.

If you would like to use the Device Description files exclusively for the purpose of communicating information to a HART or FOUNDATION fieldbus host, FCII grants to you a non-exclusive, non-transferable license solely for this express purpose. The license prohibits any and all other uses of the Device Description files. A prohibited use terminates the license. No other interests, including rights under patents or copyrights, are granted by the license, either implicitly or explicitly.

NO WARRANTY: FCII DOES NOT WARRANT THAT THE DEVICE DESCRIPTION FILES WILL MEET YOUR REQUIREMENTS. THE DEVICE DESCRIPTION FILES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARITUCLAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE DEVICE DESCRIPTION FILES IS WITH YOU. IN NO EVENT WILL FCII BE LIABLE FOR ANY DAMAGES ARISING OUT OF ANY CAUSES WHATSOEVER (WHETHER SUCH CAUSES BE BASED IN CONTRACT, NEGLIGENCE, STRICT LIABILITY, OTHER TORT, PATENT INFRINGEMENT, OR OTHERWISE), INCLUDING ANY LOST PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH DEVICE DESCRIPTION FILES EVEN IF FCII HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR OF ANY CLAIM BY ANY OTHER PARTY.
